On June 12th, the European Commission (hereinafter referred to as the "Commission") released a preliminary ruling on the anti subsidy investigation of electric vehicles in China, revealing that it plans to impose a temporary anti subsidy tax of up to 38.1% on electric vehicles imported from China. The spokesperson of the Ministry of Commerce responded that the determination in the disclosure of the European ruling lacks factual and legal basis. China urges the EU to immediately correct its erroneous practices, effectively implement the important consensus reached at the recent trilateral meeting of leaders from China, France, and Europe, and properly handle economic and trade frictions through dialogue and consultation. China will closely monitor the follow-up progress of the European side and resolutely take all necessary measures to firmly defend the legitimate rights and interests of Chinese enterprises.

On June 12th local time, the European Commission released a preliminary ruling on the investigation of anti subsidy measures against electric vehicles imported from China, revealing plans to impose temporary anti subsidy taxes on electric vehicles imported from China. From the perspective of temporary tariff levels, three Chinese car manufacturers, BYD, Geely, and SAIC Group, will be subject to tariffs of 17.4%, 20%, and 38.1%. Other electric car manufacturers who participated in the survey but were not sampled will be subject to a weighted average tax of 21%. The European Commission stated that if effective solutions cannot be reached through discussions with the Chinese side, these temporary tariffs will be introduced from July 4th.

A spokesperson for the Ministry of Commerce stated that the determination in the disclosure of the European ruling lacks factual and legal basis. The European Commission disregards the objective fact that China's advantages in electric vehicles come from open competition, disregards the rules of the World Trade Organization, disregards the comprehensive cooperation of relevant Chinese enterprises in relevant investigations, artificially constructs and exaggerates so-called "subsidy" projects, abuses the "obtainable facts" rule, and determines abnormally high subsidy amounts. This is a blatant protectionist behavior, creating and escalating trade frictions, and "undermining fair competition" under the pretext of "maintaining fair competition", which is the greatest "unfairness". This move by the European side not only damages the legitimate rights and interests of China's electric vehicle industry, but also disrupts and distorts the global automotive industry supply chain, including the European Union.

A spokesperson for the Ministry of Commerce stated that the European Commission, holding high the banner of green development and waving a "protectionist" baton, politicizes and weaponizes economic and trade issues, which is not in line with the consensus spirit of China Europe leaders on strengthening cooperation. It will affect the atmosphere of bilateral economic and trade cooperation between China and Europe, not conducive to the interests of EU consumers themselves, and will also undermine the overall situation of the EU's own green transformation and global cooperation in addressing climate change.
